Terms of Service

These Terms of Service ("Terms") govern your use of EcomKaptaan ("the Service"), available at https://ecomkaptaan.com. By creating an account or using the Service you agree to these Terms.

1. The Service

EcomKaptaan is an AI-powered ecommerce operations platform: it connects to your store and business tools (ecommerce platforms, couriers, messaging channels, email) and uses AI agents to answer customer messages, manage orders and shipments, process returns, score order risk, and generate reports.

2. Your account

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be legally able to operate the store(s) you connect.

3. Your data and your customers

• You retain ownership of your store data and your customers' data.
• You are responsible for having the right to process your customers' information through the Service and for complying with the laws that apply to your business (including consent for messaging channels such as WhatsApp and email).
• Our handling of data is described in the Privacy Policy.

4. AI features

The Service uses AI to generate replies, take routine actions (for example confirming or cancelling orders, creating return tickets), and produce analytics. AI output can be imperfect. You are responsible for supervising the AI agents you enable, reviewing escalated items, and the final decisions made in your store. High-impact actions are designed to require human review, and every agent can be disabled per store.

5. Third-party services

Integrations (ecommerce platforms, couriers, Google/Gmail, Meta/WhatsApp, and others) are provided by third parties under their own terms. We are not responsible for their availability or actions. You may disconnect any integration at any time.

6. Acceptable use

• No unlawful, fraudulent, or deceptive activity.
• No spam: messaging features may only be used to contact customers you are entitled to contact.
• No attempts to disrupt, reverse engineer, or gain unauthorized access to the Service.

7. Fees

Paid plans, where offered, are billed as described at the time of purchase. Fees are non-refundable except where required by law.

8. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, EcomKaptaan is not liable for indirect, incidental, or consequential damages, or for losses resulting from AI-generated content or actions, third-party integrations, or events beyond our reasonable control. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

9. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms.

10. Changes

We may update these Terms; material changes will be reflected by updating the effective date above. Continued use after changes means you accept the updated Terms.
